The Police in the USA has to follow a drill. Any violation of that drill, drops their privileges such as stopping a citizen on his cause. Telling immediately and clearly the justification of the stop is a must.
Asking if the fire arm is on his body or in reach, explaining that the Officer is asking for his own safety is another one. Their is no reasonable doubt that the citizen is a threat and instead the tinted window ticket must be checked and if the man has had time to fix the violation or asked for a court ruling.
Pulling a gun on another human allows lethal force.
The USA is no Germany.
